Receptree Terms of Service

1. Service Description

Receptree is a global platform for photography enthusiasts to create, share, compare, and manage Fujifilm film simulation recipes. Users can upload example images, share content publicly with the community, or store content privately for personal use.

Note: Receptree is a platform operated by Novasas. All legal responsibilities and agreements are with Novasas.

2. Eligibility

You must be at least 16 years old to use the Service.

3. User Accounts

• Maintain confidentiality of your account credentials.
• Provide accurate and truthful information.
• Notify us immediately of unauthorized account use.
• Novasas may suspend or terminate accounts violating these Terms.

4. User Content

4.1 Ownership and License

You retain ownership of all content you upload ("User Content").

Public Content: By sharing content with the community, you grant Novasas a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to host, display, distribute, and process the content for operating and improving the Service. Other users may view and share your public content within the Service.

Private Content: Content marked as private remains solely your property. You grant Novasas a limited license only to store, organize, and display it to you within your account. Private content is not shared with other users or third parties.

4.2 Responsibility for Content

You are solely responsible for your User Content. Ensure it:

• Does not infringe intellectual property rights, privacy rights, or data protection laws.
• Does not depict identifiable individuals without consent.
• Complies with applicable laws.

4.3 Content Removal

Novasas may remove content violating these Terms or the law. Private content will only be deleted at your request. Copies may persist in secure backups for up to 30 days.

4.4 Analytics Use

Private content may be used in aggregated and anonymized form to improve the Service. Individual content is never identifiable in analytics.

5. Reporting, Moderation, and Abuse

• Report violations via the in-app feature or support@novasas.ch.
• Novasas may remove or restrict content at its discretion.
• You may request a review of moderation decisions through the same email.

6. Intellectual Property

• All rights in Receptree, including trademarks, design, and software, belong to Novasas.
• "Fujifilm" and related marks remain the property of their respective owners.

7. Copyright Infringement

• If you believe your copyright has been infringed, contact privacy@novasas.ch with required information.
• Counter-notices can be sent to the same address if you believe content was removed in error.
• Repeat infringers' accounts may be terminated.

8. Acceptable Use

You may not:

• Use the Service unlawfully or maliciously.
• Upload malware or interfere with security.
• Impersonate others.
• Scrape or access the Service via automated tools without permission.

9. Payments, Subscriptions, and Refunds

• Paid features are processed via Stripe.
• Subscription fees renew automatically unless cancelled before the renewal date.
• Payments are non-refundable except where required by law.
• Prices exclude taxes; failed payments may result in account suspension.

10. Termination

• You may delete your account at any time.
• Novasas may terminate for violations, inactivity, or operational reasons.
• Account deletion removes private and public content according to the Privacy Policy.

11. Disclaimers & Limitation of Liability

• Service is "as is" and "as available."
• Novasas is not liable for indirect or consequential damages.
• Liability is capped at the greater of CHF 100 or fees paid in the prior 12 months, to the extent permitted by law.
• Liability for death, personal injury, or willful misconduct is not excluded.

12. Indemnification

You agree to indemnify Novasas and affiliates for claims arising from:

• Your User Content
• Violation of these Terms
• Third-party rights infringements

13. Governing Law and Jurisdiction

• Swiss law applies.
• EU users retain mandatory consumer rights.
• Exclusive jurisdiction: Solothurn, Switzerland.

14. Changes to Terms

We may update these Terms. Material changes will be notified via email, in-app, or website. Continued use constitutes acceptance.

15. Miscellaneous

• Provisions regarding IP, indemnity, and liability survive termination.
• You may not assign rights without written consent.
• These Terms and the Privacy Policy constitute the entire agreement.
